Criminal Proceeds (Recovery) Amendment Bill

This bill amends the Criminal Proceeds (Recovery) Act 2009 (the Principal Act) to enable the High Court to make a disclosure of source order, on application by the Commissioner, in relation to property to which a section 24 restraining order applies if the respondent is overseas. This bill also amends both the Principal Act and the KiwiSaver Act 2006 to overcome a legal loophole to the effect that funds in a KiwiSaver scheme are not subject to forfeiture or debt recovery under the principal Act until they are withdrawn under the KiwiSaver Rules.
